1. Acceptance of Terms

By creating an account, accessing, or using SavEat's services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our services.

These Terms constitute a legally binding agreement between you and SavEat. Your continued use of the service following any changes to these Terms constitutes acceptance of those changes.

2. Eligibility

To use SavEat, you must:

Be at least 18 years of age
Have the legal capacity to enter into a binding contract
Not be prohibited from using the service under Pakistani law or any other applicable jurisdiction
Provide accurate, current, and complete information during registration
Maintain the security of your account credentials

If you are using SavEat on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

3. Description of Service

SavEat is an online marketplace platform that connects customers with restaurants to purchase surplus food at discounted prices. Our services include:

For Customers: Browsing available food items, making reservations, processing payments, and collecting food from partner restaurants
For Restaurants: Listing surplus food items, managing inventory, receiving orders, and serving customers

SavEat acts solely as an intermediary platform. We do not prepare, package, or deliver the food items. All food is prepared and provided by independent restaurant partners.

4. User Accounts

4.1 Account Registration

To use certain features of SavEat, you must create an account. You agree to:

Provide accurate, complete, and current information
Update your information promptly when it changes
Maintain the confidentiality of your password
Notify us immediately of any unauthorized use of your account
Be responsible for all activities under your account

4.2 Account Types

Customer Accounts: For individuals purchasing food items
Restaurant Accounts: For businesses listing and selling food items (subject to approval)

4.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or any other reason at our sole discretion.

5. User Responsibilities and Conduct

5.1 Prohibited Activities

You agree NOT to:

Use the service for any illegal purpose or in violation of any applicable laws
Impersonate any person or entity or falsely represent your affiliation
Interfere with or disrupt the service or servers
Attempt to gain unauthorized access to any portion of the service
Use automated systems (bots, scripts) to access the service
Collect or harvest any information from other users
Post false, misleading, or fraudulent content
Harass, abuse, or harm other users or restaurant partners
Upload viruses, malware, or any malicious code
Resell or redistribute food purchased through the platform

5.2 Customer Responsibilities

As a customer, you agree to:

Pick up your reserved items during the specified time window
Provide accurate pickup information
Cancel reservations in advance if unable to pick up
Treat restaurant staff with respect and courtesy
Pay for all orders according to the agreed terms
Not waste food intentionally

6. Restaurant Partner Terms

6.1 Restaurant Approval

Restaurant accounts require approval from SavEat. We reserve the right to accept or reject any restaurant application at our discretion. Approval may be revoked at any time.

6.2 Food Quality and Safety

Restaurant partners agree to:

Comply with all applicable food safety regulations and health codes
Provide food that is safe, fresh, and fit for consumption
Accurately describe food items and disclose allergens
Store and handle food properly until customer pickup
Maintain all necessary licenses and permits
Not list food that has expired or is unsafe for consumption

6.3 Listing Requirements

Restaurant partners must:

Provide accurate descriptions, pricing, and pickup times
Honor all confirmed reservations
Update availability in real-time
Respond to customer inquiries promptly
Process refunds as required by these Terms

6.4 Commission and Fees

SavEat may charge restaurant partners a commission or service fee for using the platform. Current fees will be communicated separately and may be updated from time to time.

7. Reservations and Orders

7.1 Making Reservations

When you make a reservation:

You are making a binding commitment to purchase the item
You agree to pick up the item during the specified time window
You acknowledge that surprise bags contain variable contents
You understand that specific items cannot be requested

7.2 Order Confirmation

A reservation is confirmed when:

Payment is successfully processed (for prepaid orders)
You receive a confirmation message or notification
The order appears in your account history

7.3 Pickup Requirements

Pickup must occur during the specified time window
You may be required to show proof of purchase
Orders not picked up during the window are considered forfeited
Late pickups are not guaranteed and are at restaurant discretion

8. Payment Terms

8.1 Pricing

All prices are displayed in Pakistani Rupees (PKR) and include applicable taxes unless otherwise stated. Prices are set by restaurant partners and may vary.

8.2 Payment Methods

We accept payment via:

Credit and debit cards
Mobile wallets (JazzCash, Easypaisa)
Cash payment at restaurant (where available)

8.3 Payment Processing

By providing payment information, you:

Represent that you are authorized to use the payment method
Authorize us to charge the payment method for your orders
Agree to pay all charges incurred

8.4 Failed Payments

If payment fails, your reservation may be cancelled. We reserve the right to suspend your account for repeated payment failures.

9. Cancellations and Refunds

9.1 Customer Cancellations

More than 2 hours before pickup: Full refund
Less than 2 hours before pickup: No refund
Missed pickup: No refund

9.2 Restaurant Cancellations

If a restaurant cancels your order, you will receive a full refund. We may also provide compensation at our discretion.

9.3 Refund Processing

Refunds are processed to the original payment method
Refunds may take 5-7 business days to appear
Some refunds may be issued as account credit

9.4 Disputes

If you have a dispute about an order, contact us within 24 hours of pickup. We will investigate and determine appropriate resolution on a case-by-case basis.

10. Intellectual Property Rights

10.1 SavEat's Property

All content on the SavEat platform, including but not limited to text, graphics, logos, images, software, and design, is the property of SavEat or its licensors and is protected by intellectual property laws.

10.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the service for its intended purpose. You may not:

Copy, modify, or distribute our content
Reverse engineer any part of the service
Remove any copyright or proprietary notices
Create derivative works based on the service

10.3 User Content

By posting reviews, photos, or other content on SavEat, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with operating the service.

11. Disclaimers and Limitations of Liability

11.1 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

The service will be uninterrupted or error-free
Defects will be corrected
The service is free of viruses or harmful components
Results from using the service will meet your expectations

11.2 Food Quality Disclaimer

SavEat is a platform connecting customers with restaurants. We do not prepare, inspect, or guarantee the quality, safety, or suitability of food items. Restaurants are solely responsible for food quality and safety.

11.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAVEAT SHALL NOT BE LIABLE FOR:

Indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, or goodwill
Food-related illness, injury, or allergic reactions
Actions or omissions of restaurant partners
Unauthorized access to your account

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC ORDER IN QUESTION, OR PKR 5,000, WHICHEVER IS LESS.

11.4 Indemnification

You agree to indemnify and hold harmless SavEat, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

Your use of the service
Your violation of these Terms
Your violation of any rights of another party
Your conduct in connection with the service

12. Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Pakistan, without regard to conflict of law principles.

12.2 Jurisdiction

Any disputes arising from these Terms or use of the service shall be subject to the exclusive jurisdiction of the courts in Islamabad, Pakistan.

12.3 Informal Resolution

Before filing any legal action, you agree to contact us and attempt to resolve the dispute informally for at least 30 days.

13. Termination

13.1 By You

You may terminate your account at any time by contacting us. Upon termination:

Your right to use the service will immediately cease
Outstanding orders must still be honored
Refunds will be processed according to our refund policy

13.2 By Us

We may suspend or terminate your account immediately if:

You violate these Terms
We suspect fraudulent or illegal activity
You repeatedly miss pickups without cancelling
You engage in abusive behavior toward restaurant partners
Required by law or legal process

13.3 Effect of Termination

Upon termination, all provisions that should survive (payment obligations, disclaimers, limitations of liability, etc.) will continue to apply.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the website. Material changes will be communicated via email or prominent notice on the platform.

Your continued use of the service after changes constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the service.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SavEat regarding use of the service.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.

15.5 Force Majeure

We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, riots, or technical failures.
